  1. The Contest shall run from 7th Dec '10 and end on 17th Dec'10 (both days inclusive) at 23:59 hrs in the night (hereinafter referred as "Contest Period").
  2. The Contest is organized by Tata Teleservices Limited (TTSL). The Contest is valid only in India.
  3. Contestant eligible to participate in the Contest in accordance the eligibility criteria specified in point no. 4 of this Terms and Condition and participating in the Contest are hereinafter referred to as the “Participant/s”
  4. To be eligible to play the Contest, the Participant/s need to confirm to following eligibility criteria:
    • an Individual,
    • Indian citizen,
    • residing in India,
    • aged 18 years and above,
    • legally eligible to enter into a contract
    • must have a valid Facebook ID or must have a valid Twitter ID
    • participate in the Contest by doing either of the following:
      1. Play with their Facebook ID or
      2. Play with their Twitter ID
  5. To participate in the Contest, a Participant has to visit www.facebook.com/tatadocomo or www.twitter.com/tatadocomo.
  6. Information as available on the Contest page is the only authentic and valid information about the Contest. TTSL shall not be responsible for any incorrect / misleading information relating to the Contest, presented / displayed on any other source other than the Contest page on www.facebook.com/tatadocomo and www.twitter.com/tatadocomo. TTSL will not be liable for any loss suffered by any Participant based on the representation, terms, conditions, information presented / displayed on any other source other than the Contest page.
  7. To participate in the Contest, Participant/s has to follow following steps:
    • Log into valid Facebook id or Twitter id.
    • If not already a friend of Tata DOCOMO official community (www.facebook.com/tatadocomo), the Participant needs to add the Official community as his friend on Facebook.
    • If not already a follower of Tata DOCOMO official community on Twitter (www.twitter.com/tatadocomo), the Participant needs to follow Tata DOCOMO Official community on Twitter.
    • Select the application that is residing on the screen after logging onto the Facebook.com or Twitter.com
      • Using the application Participant has to write a 'status update' (as applicable for Facebook) or tweet (as applicable on the Twitter) on the brief given as part of Contest which is – ‘Rules of Smartness’
  8. The application will then auto-reflect the Participant's response on his Facebook profile id and/or his Twitter profile id.
  9. Participant/s doesn't need to write about TTSL or Tata DOCOMO at all in his 'status updates' / tweets. The subject matter of his post is completely upto his discretion. No additional merit will be allocated to posts with subject matter being or related to TTSL or TATA DOCOMO.
  10. Each person who logs onto the application residing on www.facebook.com/tatadocomo or www.twitter.com/tatadocomo as explained in clause 6,  7 and 8 specified above, and posts his response on his Facebook profile id and/or his Twitter profile id is assumed to be a "Participant/s'' for the Contest.
  11. Response submitted by the Participant/s will be evaluated by the panel of jury appointed by TTSL.
  12. Every weekday during the Contest Period i.e. (7th December 2010 onwards) panel of jury will select one Daily winner of the Contest based on the most innovative response submitted by the Participant/s during the day prior to the declaration and the date of declaration of Daily winner. No winner announcements will be made for Contest participation done on weekends.
  13. Entries from winners of previous Tata DOCOMO contest will not be considered for evaluation until the last day of the contest. However all exceptional entries from past winners will be clubbed together along with entries from other participants and evaluated ONLY on the LAST day of the contest.
  14. Jury's decision on the selection of Daily winner(s), will be final and binding on all the Participant/
  15. The Participants can post a maximum of 15 entries each per day from his Facebook or Twitter id, that he is using to participate in the Contest.
  16. Single Participant participating in the Contest from multiple id's on Facebook.com or Twitter.com or from multiple id's on Facebook.com and Twitter.com will be disqualified from participating in the Contest and winning Prize/s under the Contest.
  17. This Contest is open to individuals only. Corporate, Agencies, employees of TTSL, its business associates and their immediate family members are not allowed to take part in this Contest.
  18. There is no entry fee or participation fee payable by the Participant/s for participating in this Contest. TTSL will not accept any form of payment from any of the Participant/s interested in participating in the Contest, further participating in the Contest will not in itself make the Participant eligible for the Prize.
  19. Each winner of the Contest (as defined under point 12) will be entitled to a Nokia Handset.
  20. The Participant/s understand that the prize/s under the Contest are provided by Nokia and TTSL shall not be responsible for non-delivery or shortfall or deficiency in prize/s and all the legal remedies in relation to the prize/s solely lie against Nokia.
  21. The Prize/s shall be subject to the laws of India, including all the tax laws. All applicable regulatory and statutory duties, cess, surcharges, taxes (including TDS), insurances, transfer fees, registration fees etc. that may be applicable to avail/use the Prize/s will be borne by the winner/s of the Contest.
  22. The panel of jury has sole discretion in the interpretation and enforcement of Contest rules, including but not limited to selection of winner and suspension of response(s) or Participants.
  23. The response to this Contest must be original and conform to decency guidelines. Any response deemed to contain content that depicts violence, immoral, unethical, illegal, anti-social, racial, political, anti-religious, sexual or any other inflammatory, defamatory or objectionable material will be disqualified and removed from www.facebook.com/tatadocomo and/or www.twitter.com/tatadocomo. TTSL reserves the right to initiate legal action against such Participants. Interpretation of what is, and is not, appropriate material is at the sole discretion of TTSL.
  24. The Participants should not deface or disparage the brand Tata DOCOMO in any manner in the process of creating and posting their response.
  25. The Participant cannot create similar response(s) as submitted for this Contest at any other blog/forum or any other site, or any other Contest of similar nature.
  26. TTSL will have no liability, in case someone is not able to participate on account of his inability to access the contest links as provided on www.facebook.com/tatadocomo and / or www.twitter.com/tatadocomo.
  27. Participant/s winning the Prize/s should contact Nokia  /  Nokia Customer care directly in case of any complaints relating to the defect in the Prize and TTSL will not be held liable for any such defect, default, damage, malfunctioning of the prize/s.
  28. TTSL will not be liable for any loss, claim, damage, expenses whether expressed, implied, real, consequential incurred by the Participant due to participation in the Contest.
  29. The participants understand that the Nokia  handsets offered as Prize to the Contest winners are new and unused handsets. However TTSL is not responsible for any deficiency in the Prizes and does not make representation about the quality, make, performance, features, endurance, finishing, benefits or fitness of the Prizes.
  30. The winners will be intimated within 14 days of the conclusion of Contest, by way of email on the email id of the winner on the applicable platform/s. In the event of no response/acknowledgement from the concerned winner to the email communication within 30 days, then his prize will be forfeited.
  31. The winners should submit the necessary documentation / proof of identity and other relevant documentation, which TTSL requests for, within 14 days of receiving intimation of being selected as winner of the Contest by TTSL.
  32. The prizes will be distributed / delivered to the winners by TTSL, within 30 days of submission of all necessary documents to TTSL by the winners, at the respective addresses of the winners. If the winner absents from taking the delivery of the prize and fails to collect the same within 30 days from submission of requisite documents, then his prize stands forfeited.
  33. The prizes are non-endorsable, not transferable and non-substitutable. The prizes are offered on 'NO EXCHANGE NO REFUND' basis.
  34. TTSL will entertain no requests for exchange in lieu of the prize/s.
  35. Apart from the entitlement to the above prize/s, the winners and/or their legal heirs will have no other rights or claims against.
  36. Each winner should provide following documents to TTSL for enabling TTSL to gratify the winner:
    • Name,
    • Address,
    • Photograph
    • Age proof,
    • Residence proof,
    • Proof of identity.
    • Copy of PAN Card
  37. The winner should submit the screen shot of the id/s from which he had participated in the Contest. Also the winner should submit affidavit cum indemnity bond stating that the response and the id from which the response was sent belongs to him and will keep TTSL, its employees, officer, associates indemnified against any claim, loss, dispute, damage arising out of the usage of id and submission of response from which the winning response was sent. The winner has to submit the aforesaid affidavit cum indemnity bond in the format specified by TTSL on the requisite amount of stamp paper. All the aforesaid documents have to be submitted by the winner/s for the purpose of collection of prize within 30 days of the declaration of the winners.
  38. TTSL reserves the right to modify, add or delete any of the terms and conditions or participation mechanics of the Contest at any point of time at its sole discretion without serving any prior intimation to the Participants. Intimation of any change, modification, addition, deletion in the terms and condition of the Contest will be served to the participation by posting the revised terms and condition of the Contest on TTSL portal.
  39. TTSL is not responsible for Participant not being able understand the Contest mechanics or for his misinterpretation of the same. No correspondence, clarification, explanation in this regard will be entertained by TTSL.
  40. Any disputes with respect to the Contest shall be subject to the sole jurisdiction of courts in Delhi.
  41. TTSL shall have the right to use the response (s), in any media for brand, products, business or any other objective as it may deem fit. TTSL also reserves the right to display the response (s) on any medium (Online, TV etc) or vehicle it deems appropriate.
  42. The Participant shall indemnify TTSL against any claims from any party and consequent losses, damages, compensation, whatsoever, that may arise from any use, including but not limited to, publication of response (s) submitted by the Participant as a part of, or in association with the Contest.
  43. TTSL shall not be liable for any failure to comply with its obligations caused by weather conditions, fire, flood, strike, hurricane, industrial dispute, war, hostilities, terrorist attack, political unrest, riots, civil commotion, inevitable accidents, acts of God or any other circumstances amounting to Force Majeure.
  44. TTSL shall not be responsible for any loss or damage if it has to discontinue or cancel this Contest in compliance with any law, ruling, order, regulation, requirement or instruction of any Central/State Government or for any other unavoidable reason beyond its control. The Participant/s shall be informed of such discontinuance/cancellation as soon as possible, through www.facebook.com/tatadocomo or www.twitter.com/tatadocomo.
